Acceptance of Terms

By downloading, installing, or using BubbleTalk, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the application. These terms constitute a legally binding agreement between you and BeautifulMinds Africa.

Description of Service

BubbleTalk is a communication support application designed to help parents and caregivers create visual communication tools for children. The app provides features including communication boards, visual schedules, emotion tracking, and AI-generated symbol images. The app is intended as a supplementary tool and is not a substitute for professional speech therapy or medical advice.

User Accounts

You must create an account to use BubbleTalk. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these terms.

Acceptable Use

You agree to use BubbleTalk only for its intended purpose of supporting communication with children. You must not use the service to generate inappropriate, offensive, or harmful content. You must not attempt to reverse-engineer, decompile, or disassemble any part of the application. You must not use automated systems or bots to access the service. Misuse of AI symbol generation features may result in account suspension.

Subscriptions and Payments

BubbleTalk offers both free and paid subscription tiers. Free accounts are subject to usage limits on boards, symbol generations, schedule steps, and child profiles. Pro subscriptions are billed monthly and provide unlimited access to all features. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are handled according to the policies of the Apple App Store or Google Play Store through which the purchase was made.

Intellectual Property

All content, features, and functionality of BubbleTalk, including but not limited to text, graphics, logos, and software, are the property of BeautifulMinds Africa and are protected by intellectual property laws. AI-generated symbol images created through your account are licensed to you for personal, non-commercial use within the application. You may not reproduce, distribute, or create derivative works from our proprietary content without express written permission.

AI-Generated Content

Symbols generated by our AI service are provided "as is". While we strive for accuracy and appropriateness, we cannot guarantee that all generated images will meet your expectations. You are responsible for reviewing generated content before using it with your child. We reserve the right to remove any generated content that violates our content guidelines. Generation limits apply based on your subscription tier.

Limitation of Liability

BubbleTalk is provided on an "as is" and "as available" basis. BeautifulMinds Africa makes no warranties, express or implied, regarding the reliability, accuracy, or availability of the service. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

Disclaimer

BubbleTalk is not a medical device and should not be used as a replacement for professional speech therapy, behavioural therapy, or medical treatment. The app is designed as a supplementary communication aid. Always consult qualified healthcare professionals for your child's specific needs. We do not make any claims about therapeutic outcomes from using the application.

Indemnification

You agree to indemnify and hold harmless BeautifulMinds Africa, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the application, your violation of these terms, or your infringement of any third-party rights.

Termination

We may terminate or suspend your access to BubbleTalk at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the service will immediately cease. Data deletion following termination will be handled in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or your use of BubbleTalk shall be subject to the exclusive jurisdiction of the courts of South Africa.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the application. Continued use of BubbleTalk after changes are posted constitutes acceptance of the modified terms. If you disagree with any changes, you should discontinue use of the application.
